Terms and Conditions
1.1. These General Terms and Conditions apply to all offers, bookings and agreements relating to all accommodations and other facilities rented out by Triangular Mars LTD under the following brand name – “Mars Hostel” (‘MARS ’).
1.2. In these General Terms and Conditions, the term ‘renter’ means: the person who concludes an agreement with MARS regarding the rent/use of accommodation. The term ‘user’ means: the renter and any persons who will make
use of the accommodation E.S rented by the renter and/or other facilities.
1.3. These General Terms and Conditions shall apply regardless of your (prior) reference to any terms of your own or to any other general terms and conditions. MARS rejects all General Terms and/or Conditions to which you may refer
or which you use or adopt. Including Reservation websites, Agents and third party references.
1.4. Any agreements deviating from these General Terms and Conditions shall be valid only if agreed in writing.
2.1. MARS shall only handle bookings/reservations made by persons of 18 years and over. Bookings/reservations made by persons under the age of 18 shall be invalid.
2.2. MARS reserves the right at all times to refuse (or set special conditions) to handle any non-standard bookings, particularly from groups, without giving reasons.
2.3. Should MARS handle your booking MARS shall send you confirmation. Upon request MARS will send an Invoice within 14 days after checkout. You are to check this for accuracy immediately upon receipt and notify MARS of any
2.4. If you have not received reservation confirmation within 14 days of booking, you should contact the booking office immediately; no claims on the grounds of the booking shall be accepted should you have failed to do so.
2.5. An agreement between you and MARS shall exist from the moment MARS has confirmed your reservation.
2.6. This agreement relates to the letting of accommodation or other facilities for recreational use, which by its nature is short term.
3. Amendments to the agreement
3.1. If, after the agreement has been made, you wish to make any amendments to the agreement, MARS shall not be obliged to accept such. MARS may at their discretion determine whether and to what extent such amendments shall
be accepted. Changing dates of arrival and/or location from 1 day before arrival are not allowed. In these cases, the cancellation costs as described in Article 14 of these General Terms and Conditions apply.
3.2. If you want to amend the number of accommodation after the conclusion of an agreement for more than one accommodation, the cancellation conditions as described in Article 15 of these General Terms and Conditions will apply.
4.1. The company, the renter and other users are not permitted to allow persons other than those specified in the agreement to use the accommodation, by whatever name called and in any capacity whatsoever, unless otherwise agreed with MARS.
4.2. If you and MARS have agreed that you and/or one or more users are to be replaced, you shall remain severally liable, in addition to the renter and/or users who replace you and/or other users, vis-à-vis MARS for the payment of
any part of the rent still due, the amendment costs (see Clause 3.1), any additional costs resulting from the replacement and any cancellation costs.
5.1. You shall owe MARS the agreed rent as specified in the booking confirmation.
5.2. Once MARS has sent you the booking confirmation your booking shall no longer qualify for price discounts and/or special offers.
5.3. Insofar as applicable, all prices are Excluding of VAT unless otherwise stated.
5.4. MARS is entitled to enforce and pass on price increases, resulting from intervening changes in statutory regulations and/or provisions (including but not limited to VAT and additional taxes such as City tax, Tourist tax) over which
MARS has no control of.
5.5. The exchange rate will be not less than 3.8 NIS per USD.
6. Extra costs
6.1. The amount of VAT is determined by the government of Israel and may change from time to time. Israeli Citizens are always obliged to pay the VAT tax.
7.1. MARS must receive the amount of rent due on day of check in.
7.2. Group Reservation –A reservation of more than 5 guests is considered as “GROUP RESERVATION”. In the event of group reservation 50% of booking amount will be charged on the day of booking. The remaining balance should be paid in full up to 14 days before arrival date. If you fail to pay in accordance with the above specifications MARS may deny you the use of the accommodation and/ or other facilities. Should it later emerge that you had indeed issued a payment order but that the amount had not yet been paid into the MARS bank account by the time of your arrival, the excess amount paid will be repaid in
7.4. Should the reservation amounts not have been paid promptly you shall be in default immediately upon expiry of the payment term. In such event MARS shall offer you the option of paying the amount due within 1 day. If payment
is still not made, MARS shall be entitled to dissolve (cancel) the agreement as of the day the 1-day term has passed and you shall be liable for any damages incurred or yet to be incurred by MARS in connection with your booking and the dissolution thereof. MARS shall, in any event, be entitled to charge cancellation costs for each accommodation. In such case the provisions of Clause 15 shall apply.
7.5. MARS shall be entitled at all times and on any account whatsoever to set off any amounts receivable from you / or any amounts paid by you, on any account whatsoever.
8. Arrival and departure
8.1. The rented accommodation shall be available to you from 14:00 p.m. on the agreed day of arrival as specified in the booking confirmation. On the agreed day of departure specified in the booking confirmation the accommodation
is to be vacated before 11:00 a.m.
8.2. If you wish to extend the agreement with MARS beyond the agreed duration of staying, and MARS agrees such, MARS shall at all times be entitled to collect additional payment and allocate you a different accommodation.
8.3. If the use of the accommodation and/or other facility is terminated earlier than the agreed date specified in the booking confirmation, the renter shall not be entitled to any repayment of (part of) the rent and/or costs.
9.1. All guests must comply with the rules established by MARS as laid down. You can obtain these Regulations from the reception office or from operation manager upon arrival to the apartment.
9.2. In conformity with local byelaws, proof of identity must be produced upon request when checking in. MARS cannot accommodate guests who are unable to produce proof of their identity.
9.3. Each accommodation may only be occupied by the number of guests specified in the reservation confirmation and in this agreement. In situation of additional guest found in the apartment, an additional charge of 50$ per night for
entire duration of staying will be charged.
9.4. MARS reserves the right to change the check in and check out time. If it is necessary that maintenance work be carried out you shall allow such work to be carried out on the accommodation or other facilities during your stay, without being entitled to any compensation.
9.5. The guest must leave the accommodation clean and tidy as given Dirty bed linen and towels folded into dedicated plastic bag, garbage moved out of the premises and placed at
dedicated facility outside the building, lights, water heater and A/C switched off).
9.6. In the event of incorrect use or failure to leave the accommodation in good condition, including but not limited to it being excessively dirty, extra costs of 150 $ will be charged, which you shall then be obliged to pay immediately.
9.7. Should there be any breach of the rules set out in these General Terms and Conditions and/or nonobservance of staff instructions in respect of Regulations, MARS shall be entitled to remove you, the renter and any other user from the accommodation immediately without repayment of the rent or any part thereof.
9.8. Should the management seriously suspect that the renter of a hostel bed or private room is acting contrary to the law and/or public order and/or public decency, the management shall entitled be to gain access to the hostel bed to private room.
11. Use of accommodation; inventory
11.1. The renter/user and the people accompanying the renter are jointly and severely liable for the orderly state of affairs in and around the rented accommodation and elsewhere in the building, for the use of the accommodation and
for any equipment provided.
11.2. The renter/user and the people that accompany the renter are also jointly and severely liable for any damage that results from breakage and/or loss and/ or damage to the inventory and/or accommodation. Any damages/ breakage/ damage or loss of inventory must be reported to MARS and paid for immediately, unless the renter notifies MARS via email within 12 hours after actual check in time.
12. Internet use
12.1. Depending on the accommodation, MARS offers the renter and those accompanying the renter/user access to the internet via WiFi network
12.2. The rented is responsible for the correct use of the Internet as well as for the necessary hardware and software, configurations, peripherals and supporting connections and measures to secure the computer or operating system.
12.3. MARS is not liable for any loss as a result of the use of the Internet or breakdowns in the network.
12.4. The renter/user and those accompanying the renter are expected to use the Internet responsibly and carefully and to respect the statutory regulations. They will refrain from any behavior causing a nuisance to other Internet users
or causing damage to MARS in the broadest sense of the word. The renter and those accompanying him/her shall refrain from visiting Internet web sites of an unlawful nature or not consistent with the reputation of MARS as a provider of accommodation ES.
12.5. In the case of observed or suspected nuisance to third parties and/or (other) Internet misuse by the renter/user or those accompanying the renter, MARS shall have the right to block access to the Internet, either completely or in
12.6. the renter shall indemnify MARS against any claims by third parties for reimbursement of loss for which those third parties might seek recourse from MARS in any way, in so far as such claim is based on the use made of the Internet
by the renter/user or those accompanying the renter.
13.1. In some cases, MARS may require a credit card security deposit from you at the start of your stay. The deposit per accommodation is $100 per guest, this amount can be increased by MARS in case the circumstances give cause (for example rental by groups).
13.2. The purpose of the deposit is to cover damages and/or costs, in the broadest sense of the word, that MARS can suffer if the renter/user or any of the people that accompany the renter do not adhere to their obligations.
13.3. If the deposit is not paid immediately MARS is entitled to deny the renter and/or other users access to and the use of the accommodation.
13.4. If you fail to pay the deposit, MARS is also entitled to dissolve (cancel) the agreement with immediate effect.
13.5. The entire deposit, or any deposit remaining after any claims of MARS on the renter and/or users have been settled (damage or lost to inventory, accommodation and/or other costs), will be refunded within 7 days after checkout.
This repayment will not affect any (additional) claims to compensation.
14. Cancellation costs
14.1. Cancellation costs shall be payable if a reservation is cancelled. cancellation costs are 1 Full night of the total amount nights for reservations cancelled within 24 prior the day of arrival and, in the event of cancellation after arrival, the total amount will be charged.
14.2. NO SHOW – If you have not arrived within 24 hours after the agreed date without notice, this shall be deemed to be a cancellation and charge of 100%.
15. Force majeure and change
15.1. In the event that MARS is not able to perform the agreement, in whole or in part, temporarily or otherwise, due to force majeure, it shall present you with a change proposal (for other accommodation/another period, etc.).
15.2. Force majeure on the part of MARS shall exist if the performance of the agreement is hindered, in whole or in part, temporarily or otherwise, by circumstances beyond the control of MARS, such including war risk, staff strikes,
blockades, fire, flooding, and/or any other disruptions or events.
15.3. You are entitled to reject said change proposal. If you reject the change proposal you must give notice of such within 7 days of receiving the change proposal. In such case MARS shall be entitled to dissolve the agreement with immediate effect. You will then be entitled to cancel the reservation sum and/or to a refund of any part thereof already paid. In such case MARS shall not be bound to pay any compensation.
16.1. MARS shall be entitled at all times to terminate the agreement with immediate effect if, when making the booking, your personal details and/or the personal details of other users are incomplete and/or inaccurate. In such case there will be no repayment of the rental sum or any part thereof.
17.1. MARS shall not accept any liability for theft (including theft from room, public area or building area), loss of or damage to goods or persons, of any nature whatsoever, during or as a result of a stay at one of our apartments and/or the
rent/use of accommodation and/or other MARS facilities.
17.2. MARS is not liable for disruptions in the services or defects in the services provided by third parties.
17.3. You are severally liable together with the user for any loss and/or damage to the rented accommodation and/or other property of MARS, occurring during the use thereof by you and/or other users, regardless whether or not such
is a result of actions or omissions on the part of yourself and/ or third parties.
17.4. You shall indemnify MARS against all claims relating to damage incurred by any third party resulting from any action on the part of yourself, other users, your travel companions or third parties who are in the apartment with your permission.
Information Collection and Use
We collect several different types of information for various purposes to provide and improve our Service to you.
18. Collection of Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:
First name and last name
Address, State, Province, ZIP/Postal code, City
Cookies and Usage Data
We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.
18.1 Usage Data
We may also collect information on how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
18.2. Tracking & Cookies Data
Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse our Service.

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
If you are located outside Israel and choose to provide information to us, please note that we transfer the data, including Personal Data, to Israel and process it there.
19. Disclosure of Data

Under certain circumstances, Mars may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
19.1. Legal Requirements
Mars may disclose your Personal Data in the good faith belief that such action is necessary to:

To protect and defend the rights or property of Mars
To prevent or investigate possible wrongdoing in connection with the Service
To protect the personal safety of users of the Service or the public

Security of Data
The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

21. Service Providers
We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.
These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
We may use third-party Service Providers to monitor and analyze the use of our Service.
21.2. For alleviation of doubt; Mars will not share credit card info with third party providers. That includes credit card numbers, expiry dates, cvv or any other related credit card info,
enabling a successful transaction.

This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

25. Children's Privacy
25.1. Our Service does not address anyone under the age of 18 (“Children”).
We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.
26.1. Despite the care taken and efforts made by MARS you might feel you have a justified complaint in respect of your accommodation. Any such complaint should, in the first instance, be lodged directly and on site with the management. Should you feel that a complaint has not been dealt with satisfactorily, you may submit your complaint in writing, within 1 month of leaving our hostel, to: Triangular Mars LTD. Guest Services
department, 21 king George St. Jerusalem 9426104 , Israel or via firstname.lastname@example.org stating your reservation number, name and address, the dates of your stay. The complaint shall then be handled with due care.
Should this also fail to lead to a satisfactory solution, you shall have up to three months after your departure from hostel to submit your complaint to the Recreation Dispute Committee in Tel Aviv, Israel, or to bring the complaint before the court of competent jurisdiction. The decision of this committee shall have the effect of a binding opinion.
27. Applicable law
27.1. The agreement between yourself and MARS is governed exclusively by Israeli Law.
28. Travel documents
28.1. It is your own responsibility to ensure that you have the valid travel documents required for your particular destination (including – VISA, Passport, and Flight Tickets etc). MARS will accept no liability whatsoever for the ensuing
consequences of your not having the required travel documents in your possession.
29.1. All data you give us will be recorded in a database. The database will be used for our guest administration. These data may also be used to provide specific information on and offers for our or allied products and services, either by
us or third parties. This concerns among others things also products and services of the various business units of Triangular Mars LTD, or of which MARS is part of. In order to tailor such information and offers to your interests as much as possible, we may combine your data with data held by other companies.
29.2. At your request, we will correct, supplement, delete or protect your details, if they are, for example, factually incorrect. This can mean that you will no longer be able to use some or all of our services. You are entitled to request us
to notify you when personal information related to you has been processed.
29.3. If you would prefer not to be sent interesting information or offers, please let us know by sending a card to Triangular Mars LTD. Guest Services

30.1. MARS will send correspondence digitally, unless this proves not to be possible.
30.2. Apparent printing and typing errors shall not bind MARS.
